Photography Terms & Conditions
By checking the box on the inquiry form, you acknowledge that you have read and agree to the following terms. These terms apply to all photography services provided by Omar, operating as Glow by Omar, based in Hanover Park, IL.
1. No Raw File Delivery
Raw, unedited image files are not delivered under any circumstances. All deliverables are professionally edited JPEG or digital files selected and processed at the photographer's discretion. Requests for raw files will not be fulfilled regardless of the session package.
2. Editing & Delivery Timeline
Delivery timelines vary by session type. Standard sessions — including mini sessions, portraits, couples & engagement, and lifestyle — are typically delivered within 2–3 weeks. Larger coverage such as events and extended shoots is quoted individually and generally takes 4 weeks or longer depending on the scope; an estimated timeline will be communicated at booking. For packages that include client photo selection, the editing timeline begins once the client submits their selections. The photographer will notify the client of any delays as soon as possible.
3. Image Selection
The photographer curates which images from a session appear in the client's gallery. Not every photo taken will be included — images that are out of focus, duplicative, or otherwise not up to the photographer's standard are removed and are not subject to review by the client. For packages that include client photo selection, the client then chooses their included images (and any additional purchases) from this curated gallery, and the selected images receive final editing.
4. Photographer's Image Rights
The photographer retains full copyright ownership of all images captured during the session. Images may be used for portfolio display, social media, website content, marketing materials, and professional competitions. The client's name will not be used in connection with any image without prior consent.
5. Client Usage Rights
Upon receipt of final payment, the client receives a limited, non-exclusive license to use the delivered images for personal, non-commercial purposes — including printing, sharing on personal social media, and gifting. Selling, licensing, or using the images for commercial purposes (advertisements, product sales, stock photography, etc.) requires a separate written agreement and additional licensing fee.
6. Booking & Deposit
A session is not confirmed until a deposit is received and a booking confirmation is issued. The deposit amount will be communicated at the time of booking. Deposits are non-refundable and are applied toward the total session fee. The remaining balance is due on or before the session date unless otherwise agreed in writing.
7. Rescheduling & Cancellations
Clients may reschedule a session with at least 48 hours' notice at no additional charge, subject to availability. Cancellations made within 24 hours of the session date forfeit the deposit. If the photographer must cancel due to an emergency or illness, a full refund of the deposit will be issued or the session will be rescheduled at the client's preference.
8. Outdoor & Weather Conditions
For outdoor sessions, the photographer reserves the right to reschedule if weather conditions are unsafe or would significantly compromise image quality (heavy rain, lightning, extreme wind). The decision to reschedule due to weather rests with the photographer and will be communicated as early as possible.
9. Limitation of Liability
The photographer's total liability for any claim arising from a session is limited to the total session fee paid by the client. The photographer is not liable for indirect, incidental, or consequential damages. In the unlikely event of equipment failure, file corruption, or other circumstances beyond the photographer's control that result in loss of images, liability is limited to a re-shoot at no charge or a full refund, at the photographer's discretion.
10. Governing Law
These terms are governed by the laws of the State of Illinois. Any disputes arising from photography services shall be resolved in DuPage County, Illinois.
